The Scope of the Online Paperless Registration Pilot of Intellectual Property Pledge by Banking Financial Institutions will be Expanded in Jiangsu Province

In order to implement the Special Action Plan for Patent Transformation and Utilization (GBF [2023] No. 37) and the decision arrangements of the CPC Jiangsu Provincial and the Jiangsu Provincial People's Government to strengthen the supply of financial support for scientific and technological innovation, and to expand the scale of intellectual property pledge financing and improve the operation efficiency of the "Su's IP Loan", on January 16, the Intellectual Property Office of Jiangsu Province, in conjunction with the Jiangsu Regulatory Authority of the National Financial Regulatory Authority, issued the Notice on Expanding the Scope of Online Paperless Registration Pilot of Intellectual Property Pledge by Banking Financial Institutions (hereinafter referred to as the "Notice"), which clearly states that starting from February 1, 2024, banking institutions will fully implement online registration of intellectual property pledge, and the scope of pilot banks for fully paperless processing will be expanded to all banking institutions in the province.

The Notice specifies that banks at all levels in the province can fill in related information for pledge financing online and upload scanned documents for pledge registration through the National Intellectual Property Administration's Patent Business Processing System, and complete the online acceptance process. For those that meet the registration requirements, the Nanjing Agency or Suzhou Branch of the Patent Office of the China National Intellectual Property Administration will promptly issue the "Notice of Patent Pledge Registration", and banking institutions should consider the electronic version of the Notice as having equal legal effect as the paper notice, and promptly proceed with the loan process. Furthermore, after making a commitment to the consistency between the electronic and paper documents for pledge registration, banking institutions are not required to submit paper application materials, further improving the convenience of intellectual property pledge financing registration.

The Notice requires banking institutions to strengthen organizational leadership, optimize performance assessment and incentive mechanisms, and establish professional teams for intellectual property pledge financing. They are also required to innovate product services, fully utilize the risk compensation mechanism of "Su's IP Loan", expand the scale and coverage of intellectual property pledge financing, and fulfill their main responsibilities by enhancing business management and promoting the effectiveness of pilot expansion work. Local intellectual property offices and regulatory bureaus are required to interpret policies, promptly respond to social concerns, and create a favorable atmosphere for pilot work. Meanwhile, they should strengthen guidance, promote registration in accordance with the law and regulations, resolutely investigate and punish fraudulent acts, enhance service levels, and actively conduct bank-enterprise docking activities to improve the convenience and accessibility of pledge financing registration services.

In 2022, with the approval of the China National Intellectual Property Administration and the former China Banking and Insurance Regulatory Commission, Jiangsu conducted a pilot of online registration of intellectual property pledges by banking financial institutions and explored the implementation of fully paperless processing. Over the past year, the pilot banks have actively innovated products and services, providing efficient and convenient intellectual property pledge financing services for innovative enterprises, effectively promoting the steady growth of the province's scale of intellectual property pledge financing. In 2023, the amount of intellectual property pledge financing in the province exceeded RMB 80 billion, benefiting more than 5,000 enterprises, vigorously supporting the construction of a strong province in terms of both intellectual property and finance.
